Wisconsin Self-Defense Shooting: Home Invader Dies In Menominee County :: 11/11/2014

A trio of young adult males targeted an home in Mellen township in Menominee County Wisconsin yesterday, either thinking the home was unoccupied, or that they could surprise and overpower the homeowner. They were wrong on both counts.

Police are investigating a home break-in where a man was shot and killed after he and two other men broke into a home in Mellen Township Monday morning. According to the Menominee County Sheriff’s Office, at 4:59 a.m. the 62-year-old homeowner heard the men breaking in and dialed 911 before defending himself against the intruders. Upon arrival, police found a 19-year-old man dead in the home with multiple gunshot wounds.

The 19 and 20-year-old accomplices to the home invasion were captured a short time later, hiding in the woods near the home. While a police investigation will have to take place, the presumption under castle doctrine is that the homeowner had a right to defend himself with lethal force inside his home. The two surviving home invaders could potentially be charged with their buddy's death under Wisconsin's implementation of the felony murder rule.
