West Virginia Self Defense Shooting-Intruder shot dead in Kanawha County :: 11/05/2014

CHARLESTON, W.Va. – A burglar may have taken one chance too many in Kanawha County.  Kanawha County Sheriff’s Deputies say Andrew Carter, 31, was shot and killed when he broke into a home of David Campbell, 65, in the 200 block of Campbell’s Creek Drive around 5:30 a.m. Wednesday.

“This was the second burglary that has occurred in the last 24 hours,” said Corporal Brian Humphreys of the Kanawha County Sheriff’s Department. “Additional stolen property was found across the street on a walking path not too far from the home. There’s been a string of burglaries in this area of Campbell’s Creek the Sheriff’s Department has been investigating the last couple of days.”

During Tuesday’s break-in, Campbell was not at home. He returned to his home late Tuesday night to discover the break in and a lot of his property stolen. He told neighbors he planned to report the break-in to authorities on Wednesday morning. During the early morning hours, Campbell tells authorities he heard a noise in his garage and went to investigate.  The two got into a fight and Carter was shot dead.

“My understanding was that Carter was inside the garage, which is attached to the house, when he was confronted,” Humprhreys said. “They engaged in an altercation during whitch Carter was shot.”

A full investigation is underway and Campbell has been cooperative.  Deputies do not plan to file charges against Campbell, but will present their findings to the Kanawha County prosecutor’s office to determine if charges are necessary.

Humphreys said investigators are operating under the assumption that Campbell fired the fatal shot in self defense.

The stolen property discovered across the road was taken this morning, which indicates it was the Carter’s second trip into the home Thursday morning when he was confronted and killed.
