Virginia Self-Defense: Resident who shot home invasion suspect will likely not face charges :: 10/22/2019

DUFFIELD, Va. (WJHL) — UPDATE – A Southwest Virginia man is behind bars – accused of forcing his way into an apartment. Investigators say the resident shot him.

We now know the home invasion suspect Keith Pierson is behind bars.

According to what the Scott County Sheriff’s Office has gathered so far – the tenant acted in self-defense when they say Pierson forced his way into the apartment.

“The suspect forced his way in the apartment, and the male that lives there fired a shot striking him in the leg,” Scott County Sheriff Chris Holder said.

Holder said he was charged with breaking and entering in the nighttime with the intent to commit larceny. He also said Pierson knew the tenant.

Pierson fled the scene and was found not far away about 45 minutes later.

He was taken to the hospital for non life-threatening injuries and released. We’re told he does have a criminal history.

Online court records show he’s facing drug-related charges in Scott County from an incident in September.

Investigators are still piecing together why Pierson was trying to break into the apartment.

As for the tenant – Sheriff Holder said, “Everybody has the right to protect themself. This gentleman is really badly handicapped. He can’t defend himself,” Sheriff Holder went on to say, “The homeowner was not a convicted felon, and our second amendment says we have the right to bear arms.”

Pierson is due in Scott County Court next month.

The Scott County Sheriff’s Office is still investigating the incident.
