Virginia limits gun reciprocity; judges allege North Carolina guidelines stronger :: 01/04/2016

Supporters of Virginia Lawyer General Mark Herring’s decision this current week to limit reciprocity point to his state’s quite a few disqualifiers which goal to maintain mentally ailing people, convicted felons & sure others from obtaining a hit handgun allow.

The states whose handgun permits will soon be invalid in Virginia are Alaska, Arizona, Arkansas, Delaware, Florida, Idaho, Indiana, Kansas, Kentucky, Louisiana, Minnesota, Mississippi, Montana, Nebraska, New Mexico, North Dakota, North Carolina, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Washington, Wisconsin and Wyoming. Herring’s decision to rescind reciprocity will likely result in preventing Virginians from concealed carry in other states.

Herring said concealed carry permits from Michigan, Oklahoma, Texas, Utah and West Virginia will remain valid in Virginia.

Morrisey’s office says West Virginia has full reciprocity agreements with 32 states.

The move is an effort by Democratic Governor Terry McAuliffe’s administration to take action to combat gun violence in the face of both Virginia’s Republican-led legislature and other conservative state legislatures with concealed-carry laws that are less restrictive than Virginia’s.

McLaughlin said, “If you take guns away from law abiding citizens… the only people that are going to have guns are criminals”.

Virginia permit holders won’t experience any change within their own state.

In order to qualify for recognition of a permit, also known as “reciprocity”, the out-of-state issuing authority must provide “the means for instantaneous verification of the validity of all such permits or licenses issued within that state, accessible 24 hours a day”, and “the requirements and qualifications of that state’s law” must be “adequate to prevent possession of a permit or license by persons who would be denied a permit in the Commonwealth under this article”.

Cox added that “Herring has chosen the path of making self-defense harder” by eliminating the reciprocity agreements with 25 other states. Those states hand out permits to people who are barred under the Virginia law, such as fugitives, convicted stalkers and drug dealers, which undermines the state’s law and puts residents at risk, he said. “Those standards should be applied, evenly, consistently and fairly to anyone who wants to lawfully hide a handgun in Virginia”.

“I find it remarkable that Virginia would decide that North Carolina’s laws aren’t adequate for them”, said Paul Valone, president of Grass Roots North Carolina, a pro-gun rights group.

Similar laws are on the books in North Carolina.

“Hopefully, we can overcome those vetoes“, Gilbert said. Ramsey said, “I think you’ll see repercussions from this”.
