Rand Paul wants to protect the Second Amendment and federalism :: 08/05/2016

On December 18, 2015, Senator Rand Paul introduce in the Senate S.B. 2434.

"This Act may be cited as the 'Separation of Powers Restoration and Second Amendment Protection Act.'"

SEC. 2. Sense of Congress.

It is the sense of Congress that any executive action issued by the President before, on, or after the date of enactment of this Act that infringes on the powers and duties of Congress under section 8 of article I of the Constitution of the United States or the Second Amendment to the Constitution of the United States, or that would require the expenditure of Federal funds not specifically appropriated for the purpose of the executive action, is advisory only and has no force or effect unless enacted as law.

Senator Paul is clearly worried, as we all should be, that a President Hillary Clinton will use executive orders to limit the protection of the Second Amendment.

It is also an attempt to stop the use of the president legislating by executive orders to usurp the powers of Congress under Section 8, which enumerates the specific powers of Congress.

Obviously, Obama and Hillary will never sign this bill, and we would need 67 votes to override a veto.  Presumably, Donald Trump would sign this bill.

This is an important first step for Congress to reassert its constitutional power to legislate.  Congress has largely allowed the president to issue executive orders, as Obama's executive amnesty for illegal aliens, and allowed regulatory agencies to issue regulations that have the force of law.  It is even worse with regulations issued by agencies such as HEW, IRS, OSHA, EPA that have to be challenged in court at great expense, or Congress has to specifically overrule the regulation, which rarely occurs.  This bill would help restore the balance of power in our federal system.

This bill has received virtually no publicity from the media and presidential candidates or the cable shows.  This is much more important than the Khan non-story.

It would be a good issue for Trump to support.  I urge everyone to contact his congressman and senators to support this bill.
