Proposed Pennsylvania House Legislation HB78
This legislation puts limitations on the authority of the Pennsylvania Atty. Gen. to compare Pennsylvania laws against the laws of another state when considering entering into a reciprocity agreement with that other state. In the past the "substantially similar to" language has been abused or used to negate reciprocity agreements.
The flaw in this legislation is that it still allows the attorney general to exercise latitude in entering into reciprocity agreements because of the word "may" instead of using the word "shall". This takes away any compulsion on the part of the statutory law on her decision-making process.
