Ohio Self-Defense: Employee shot man who tried to rob Cleveland cellphone store at gunpoint, police say :: 04/26/2019
CLEVELAND, Ohio – An employee shot a man who tried to rob a Cleveland cellphone store at gunpoint Tuesday in the Union-Miles neighborhood, police said.
Amhad D. Jones, 25, threatened to kill the employee before being shot just before 8 p.m. at a Metro by T-Mobile store on Harvard Avenue at East 93rd Street, according to police reports and court records.
Surveillance video from the store showed Jones point a gun at the employee before being shot, police reports say. The employee, who said he acted in self-defense and has a permit to carry a concealed weapon, is not facing criminal charges, police said Thursday.
The employee and a co-worker each told police officers that Jones came into the store saying he wanted to pay his phone bill. He pulled out a gun seconds later, and told both employees not to move, police reports say.
The employee grabbed his own gun, and Jones threatened to kill him, police reports say. The employee then fired three shots at Jones, who fell to the ground.
The employee walked over to Jones and kicked the gun away from him as he told his co-worker to call 911.
The surveillance video from the store was “extremely clear” and “mirrored” what the two employees described, investigators wrote in police reports.
Officers arrived to find Jones hurt on the ground behind the counter. He suffered gunshot wounds to the stomach, left leg and right hand, police reports say.
The employee later told police officers that he did not want to shoot anyone, but wanted to protect his co-worker and was thinking of his family. He expressed relief when he learned Jones was in stable condition at the hospital, police reports say.
Investigators took the three bullet casings, both guns and Jones’ cellphone as evidence.
An ambulance took Jones to MetroHealth for treatment. He was admitted to the hospital, but was no longer listed as a patient on Thursday, a MetroHealth spokeswoman said.
Jones is charged with aggravated robbery in the case. His first appearance in Cleveland Municipal Court has not yet been scheduled.
In 2010, Jones was sentenced to three years in prison after pleading guilty to aggravated robbery in Cuyahoga County Common Pleas Court, records say. Details of that case were not immediately available Thursday.
The Metro by T-Mobile store was closed Thursday. The employee declined to comment when reached by phone.
