NH Senate OKs bill ending concealed gun permit requirement, but veto likely :: 05/06/2016

CONCORD – Without debate, the Senate Wednesday voted down party lines 14-10 to end the requirement to obtain a permit to carry a concealed weapon.

The bill is similar to one Gov. Maggie Hassan vetoed last year. Her veto was sustained.

Under House Bill 582, a permit would no longer be required to carry a concealed weapon.

Under current law, a person may carry a loaded weapon if it is visible, but a permit is required to carry it concealed.

Supporters say local law enforcement officials have used the process to delay or even block someone with a legal right to own a gun from receiving the permit.

The bill would also allow anyone who can legally buy a gun to have one and removes the phrase “suitable person” from the permit law, which bill supporters say results in some people denied permits although they are not felons, convicted of domestic abuse or mentally ill.

But opponents argue police and town officials would lose their discretion in determining who could hold a concealed weapons permit.

Law enforcement organizations also opposed the change, saying it takes away all discretion.

Under HB 582, the concealed weapons permit would not be eliminated as many gun owners want them because of the reciprocal agreements New Hampshire has with other states. The bill also encourages the State Police director to seek reciprocal agreements with more states.

The bill goes to Hassan, who has said she would veto it and Senate Bill 336, which makes it legal for anyone who is legally able to purchase a gun to carry it concealed.

SB 336 goes before the House next week with a Criminal Justice and Public Safety Committee recommendation it be killed.
