Nevada gun rights group says Secretary of State ignored petition laws :: 12/11/2014

A statewide grassroots gun rights group told Nevada Secretary of State Ross Miller official acceptance of petition signatures as “sufficient” to qualify for a ballot measure on background checks was in violation of state law. Nevadans for State Gun Rights sent their objections by letter to Miller on Tuesday, requesting his office “immediately invalidate the petition.”

The group behind the ballot measure, Nevadans for Background Checks, has been revealed by the state’s registered business site to be an entity established by Michael Bloomberg’s Everytown team. The same players behind it were behind the recent billionaire-backed initiative in Washington State.Bill Clinton stumps for the election of his former intern Ross Miller.

Citing a November 25 letter the group had sent to Miller informing him of the violations, Nevadans for State Gun Rights President Don Turner noted the secretary had not responded, appearing to have ignored the information altogether. Rather than acting on the violations, Deputy Secretary of Elections Scott F. Gilles “declared sufficiency of signatures for the initiative,” Turner wrote.

Citing numerous instances where “documentary evidence that the state laws regarding petition requirements were violated,” irregularities identified included affidavits sworn to before all signatures were obtained, and page numbering discrepancies. Also pointed out were petitions turned in on different dates in different counties.

“Neither Nevada Revised Statutes nor Nevada Administrative Code allows for a county by county deadline for receipt of petitions,” Turner stated. “The law is very specific in that matter: All must be filed on the same day.

“It appears that, in spite of knowing that the requirements of state law were not met, your office still certified the sufficiency of the petition, which also included Storey and Lander County,” he observed. “Consequently, the ‘Notice of Sufficiency of Petition - The Background Check Initiative’ was issued contrary to state laws and administrative codes and must be invalidated, and may not be legally presented to the voters.”

For Democrat and former Bill Clinton intern Miller, having motivation to reverse the sufficiency ruling without being compelled to is uncertain at best. Anticipating a lengthy process, Turner told the Associated Press on Monday “We’re probably going to end up in court.”
