Killing of 40-year-old man by teen boy ruled self-defense :: 01/12/2016
A 14-year-old boy will not face criminal charges in the fatal shooting of a 40-year-old man after prosecutors determined the teen acted in self-defense, Milwaukee police said Monday.
Michael A. Schafrik was killed about 4:30 p.m. Tuesday in a shooting that authorities believe stemmed from an argument between two groups near S. 10th St. and W. Lincoln Ave.
The evidence given to prosecutors showed Schafrik was armed with a gun during an altercation with the 14-year-old boy, who was unarmed, Chief Deputy District Attorney Kent Lovern said in an email.
The two physically struggled and the gun fired, killing Schafrik, Lovern said.
The 14-year-old boy was taken into custody, as was a 33-year-old woman and her 14-year-old son. Police added that neither boy will face any lesser charges, and the same goes for the woman.
Lovern said Schafrik was related to another 14-year-old present during the incident. Additional details about the circumstances of the shooting were not immediately available Monday.
