Indiana Self-Defense: Police: Home intruder killed after kicking down wrong door looking for his kids :: 09/15/2017
INDIANAPOLIS, Ind. --An Indianapolis man shoots and kills an intruder during a home break-in that police say stemmed from a mistaken address.
The incident happened in the 5700 block of Wiebeck Court shortly before midnight. Knocking on a door in the middle of the night, police say a man claimed to be looking for his kids and demanded to be let inside.
“It appears he was yelling to get into the residence because he believed his kids were in the house. It turns out the kids inside did not belong to him,” said IMPD officer Aaron Hamer.
Police say the suspect, identified as 34-year-old Percy Walker kicked down the front door, breaking the deadbolt and storming inside. That’s when he was shot and killed by a man in the apartment in front of two young kids, just 2 and 4 years of age.
“Honestly they thought someone was breaking into the residence. The individual got into the house after they told him he was at the wrong location. He was upset,” said Hamer.
Police reports show this month Walker violated a protective order from the mother of his children who lives at the same apartment complex, but in a different building.
Police say the nearby addresses led to Walker’s fatal mistake overnight.
“It’s very tragic situation. Obviously we don’t want to see anyone lose their life especially going to the wrong home thinking their children are in there,” said Hamer.
The shooting is not the first time a home intruder has been killed this year in Indianapolis. In every case police say state law protects people’s right to defend their home.
“The law says in Indiana if someone is coming into your home and you believe you are in danger, you have every right to protect yourself,” said Hamer.
Ultimately it’ll be up the Marion County prosecutors to determine if any criminal charges will be filed in the case.
