Indiana Man Who Shot Intruder is Sentenced to Jail :: 11/08/2014
We have an update on a case out of Indiana. We reported back in September that David McLaughlin was convicted of shooting an intruder in April. This week he was sentenced and he will be facing jail time.
According to The Star Press:
A man who shot an intruder outside his Dunkirk home was sentenced Wednesday to 60 days in the Jay County jail, followed by four months o
n home detention.
David McLaughlin, 32, was found guilty of criminal recklessness resulting in serious bodily injury by a Jay Superior Court jury on Sept. 4. Testimony indicated he fired three gunshots April 21 at a man he said had broken into his garage, at least two after the intruder had left his property and was running down an alley.
David McLaughlin claims that when he opened fire on David A. Bailey he feared for his life due to hand movements Bailey made after McLaughlin told him to stop at gunpoint.
Despite McLaughlin testifying in his own defense that he feared for his life and despite the fact that Bailey testified that he did not commit the burglary (despite the fact that he got shot), the jury quickly returned a guilty verdict.
A somber reminder of how a defensive gun use can go, even when the suspect survives the incident.
The judge in case did agree to reduce the charge from a felony to a misdemeanor, which means McLaughlin will be able to keep his job with the United States Postal Service and will also not lose his Second Amendment rights.
