Georgia Self-Defense: Loganville Man Not Charged in Shooting Death of Brother-In-Law :: 10/28/2015

Police said no charges have been filed following a weekend fatal shooting that involved brothers-in-law.

Gwinnett Police said Tuesday morning Brian E. Davis, 48, died from multiple gunshot wounds after the incident around 6:30 p.m. Saturday, Oct. 24, at 369 Freeport Drive in unincorporated Lawrenceville.

Police believe the shooter, Jerry Hayes, 46, of Loganville, acted in self-defense.

Davis died from his injuries around 8:45 p.m. at Gwinnett Medical Center in Lawrenceville, police said

During the course of the preliminary investigation, the lead investigator determined the following:

Hayes arrived at 369 Freeport Drive to meet with a family member. Prior to approaching the front door, Davis exited the home and confronted Hayes about an altercation from several years ago. (Based on prior interaction with Davis, Hayes believed Davis was armed.)

According to Hayes, Davis appeared intoxicated. Davis began to approach Hayes. Davis was told to back up, but he continued to advance on Hayes. Davis took a beer bottle (by the neck) and began to approach and swing the bottle at Hayes.

After Davis missed striking Hayes, he (Davis) reached into his jacket. Hayes believed that Davis was about to withdraw a firearm, so Hayes withdrew his firearm and fired at Davis. Davis was struck multiple times. Hayes secured his weapon in his vehicle and waited for police to arrive.

The story was corroborated by several witnesses.

“At this time, the lead investigator has reason to believe this shooting was an act of self-defense,” Gwinnett Police Public Information Officer Cpl. Michele Pihera said in a news release. ”The shooter has not been placed under arrest and may not be charged with this homicide.”
