FOAC's Weekly Message For Sunday August 18th 2019 :: 08/18/2019

In the aftermath of another near tragedy by a career recidivist violent armed felon in Philadelphia trying to kill law enforcement officers, the anti-gun groups have continued their self-serving socialist crusade against the Freedoms and Rights of law-abiding citizens. Let’s remember that ALL of this is predicated on deranged killers, who ‘should have been stopped’ by current state and federal laws, using guns to commit their homicidal and suicidal acts of violence! The anti-second amendment gun control groups are using the blood of innocents to further their political agenda!

The hand-wringing gun grabbers, and most news outlets, are wasting no time in exploiting the deaths of innocent people by pointing their collective fingers at GUNS as the cause of the carnage and demanding they be banned ‘or’ heavily restricted.

Although these crimes are horrific and intentionally and unconscionably hyped by the media, the facts indicate there are TWICE as many people killed by shootings in Chicago EACH YEAR than in ALL of the mass shootings on US soil each year. Of course, Chicago already has STRICT gun control. That's not the story the gun grabbers and media want told to the American public.

Another fact the gun grabbers and media hide from you is that gun ownership has dramatically and steadily INCREASED nationwide over decades while the national murder rate has steadily DECREASED, which proves without question, on a national scale, that MORE GUNS=LESS CRIME.

So, the anti-gunners are DEAD WRONG. Anybody who continues to place the blame on guns, instead of attacking the REAL cause of these mass shootings, has blood on their hands from EVERY mass shooting since Columbine.

This morning (8/18) Senator Lindsay Graham was on Fox being interviewed by Maria Bartiromo and LIED to the American public when he said we need better Instant Checks to stop people like the Philadelphia criminal who shot at police! ARE YOU KIDDING ME??? The Philadelphia criminal who shot at police did NOT get his gun legally, could NOT have passed a background check of ANY kind! THEN Graham went on to advocate for Red Flag laws by using the killer in the Parkland Mass Killing as justification, LYING once again! Why was he lying? To EXCUSE the failure of government to use the current laws to hold these, and tens of thousands of other criminals, responsible for prior crimes wherein they should have already been in jail and to justify his Red Flag laws and the inane Universal Background Checks!

WHY?

Because whenever you are trying to correct, if you are acting legitimately, a bad statistic, you must analyze ALL of the factors that may be causing the unacceptable problem you are trying to correct. There are usually several factors but ONE is the RIGHT TARGET to attack, and when attacked, will have an immediate correction of the problem.

Find the RIGHT Target, attack it, and the bad statistic immediately and positively responds.

Attack the wrong target and the bad situation will not improve, and in many cases gets worse.

In analyzing statistics of mass shootings, there are several factors (targets) that have been talked about as the cause of the mass murders, including access to guns, lack of proper mental health care, violence in movies, television, and video games.

The danger in lumping all of these factors into the "cause" of mass shootings is that it appeases the public and tricks them into thinking "something has been done" but it hides the RIGHT target and mass killings not only do not stop, they become more frequent and deadlier, as we have witnessed yet again.

Isn't that EXACTLY what we have seen over the last 40 years? We have picked the wrong target, because had we selected the right target and attacked it 40 years ago, mass killings would have stopped. But they have not stopped, they have become more frequent and more deadly.

Guns are the wrong target.

Why?

Because prior to these shootings, there were just as many guns per capita and there was unrestricted access to semiautomatic weapons, even for young adults and kids. But even more evidence that guns are the wrong target is the undeniable fact that in towns, cities, schools, and shopping malls, where guns have been severely restricted and, in some cases, outright banned, the statistic of murder, HAS NOT DROPPED, IT HAS INCREASED!

Even greater evidence that proves guns are the wrong target is found in towns, cities, schools and shopping malls where law abiding, responsible citizens are allowed to carry concealed weapons. In those areas where guns are the least restricted, we see the statistic of murder and violent crime HAS DROPPED SIGNIFICANTLY.

So, if the RIGHT TARGET IS NOT GUNS, what is the right target?

To find the RIGHT TARGET look to see what CHANGES took place in society when mass shootings first began and what has increased in society directly and proportionally to the increase in mass shootings, even during the same time when strong actions and restrictions against guns and violent media were being implemented to stop the mass shootings.

The answer, the common denominator, the RIGHT TARGET in the ever increasing number of mass shootings was and continues to be the creation of strong, mind-altering, psychiatric drugs by the pharmaceutical companies and their systematic pushing of these drugs to our children and youth through our public school system, and the endless assault of prescribing anti-depression medication for adults. These drugs create the monsters who are killing their parents, teachers and schoolmates and the public at large.

THIS is the RIGHT TARGET. Ban the indiscriminate prescription and distribution of these strong, mind-altering drugs and as a society we will not have drug induced, manufactured assassins killing innocent people.

Of course to do so, would take multi-billions of dollars in ridiculous profits from the pharmaceutical companies who through their relentless "lobbying" in Washington, DC have managed to not only stay in business when all evidence points at their product as the root cause of these mass shootings, they also convinced Congress years ago to pass legislation allowing the blatant advertising of antidepressant drugs on TV, radio, Internet, newspapers and magazines.

Now you understand one of the reasons why members of Congress, who receive huge political contributions from the pharmaceutical industry, avoid attacking the RIGHT TARGET, psych drugs, and continue to point fingers at the wrong target... your guns.

The latest shooting is no different. It is not about hate or easy access to guns. It is about the anti-social, psychopathic effects of psychiatric drugs that are irresponsibly forced on society from the cradle to the grave through pharmaceutical marketing budgets that are larger than the gross national product of many third world countries and the drug pushing psychiatrists and medical doctors who prescribe them.

Philadelphia Criminal Cop Shooting Suspect Repeat Recidivist Criminal: Prohibited from Possessing Firearms

The recent shooting of at least six police officers in Philadelphia was being used as a call for gun control while the bullets were still flying. However, now that the facts are coming out that the shooter in question had a lengthy rap sheet the media is already running away from this example of the failure of gun control! As it fades from the news, Second Amendment supporters should not let that happen.

Here’s the deal, like the Dayton, Parkland and Sutherland Springs mass killers, this was a person who ‘should’ have been dealt with long ago by the Justice System. In this case, very early on, he was caught with a gun that had an altered serial number. That violation of 18 USC 922(k) should land someone five years in federal prison.

The Philadelphia criminal was busted numerous other times, including a 55-month sentence on gun charges in 2010 for two guns. That really should have been closer to 20 years, not roughly four and a half. It also does not include the numerous charges that were dropped or which didn’t result in convictions.

When we talk about helping to alleviate concerns from the suburban voters that have been far too receptive to the siren song of Bloomberg’s gun-ban agenda, addressing things like Instant Background Check System (PICS) shortcomings and law enforcement failures are things that can do just that. This is especially important when anti-Second Amendment extremists try to push unconstitutional, socialist infringements on our rights in response to a preventable tragedy.

Project Exile can do the same thing as those other items, and actually, serve as a pro-Second Amendment double play. When you look at cities like Chicago, Baltimore, and other cities with high rates of violent crime, Project Exile could be crucial to reaching out to these people, whose interest in the Second Amendment is far different than those of someone in rural Iowa or West Virginia. The provisions of 18 USC 922(d), 18 USC 922(g), 18 USC 922(i), 18 USC 922(j), and 18 USC 922(u) combined with sentencing enhancements from 18 USC 924 play a big role in this.

The benefits of supporting a revived Project Exile are obvious: We show suburban voters that we treat the misuse of Second Amendment rights seriously. Those in the crime-ridden urban areas, though, will see the worst of the worst get put away for a long time – after the express advocacy of Second Amendment supporters.

The criminal in Philadelphia is a classic example of the type of person Project Exile could take out of circulation before they got into a multi-hour shootout with cops (or cause some other tragedy). This guy’s rap sheet means that he would have been eligible for the armed career criminal enhancement provided by 18 USC 924(e) – a 15-year mandatory minimum.

Not many people know about these provisions. Tell a soccer mom that with proper action, potential killers could be stopped with existing laws on the books that just aren’t used by the same folks demanding new laws, and have the proof with these laws being used to put other bad guys away, and we get a chance to convince them that at the very least they should not support new restrictions.

Defining Freedom by Disasters: The Peril of Red Flag Laws and Assault Weapon Bans

These mass shootings are tragic, but why is it that the immediate response is a collective punishment of law-abiding, legal gun owners who have no culpability or complicity in what happened?

It is always perplexing that, when it comes to ideological agendas, the progressive socialist left will dictate what the law is.

Perhaps it is old fashioned but I thought the Supreme Court was to interpret our law, the Constitution, not make law. So, here we are once again with folks making the push to do exactly what the Second Amendment of our individual Bill of Rights prohibits. “Shall not be infringed” does not seem to be clear enough for these folks.

Yes, these mass shootings are tragic, but why is it that the immediate response is a collective punishment of law-abiding, legal gun owners who have no culpability or complicity in what happened? When I was in the military, I hated collective punishment, unless the unit was responsible for violating good order and discipline and the Uniform Code of Military Justice along with the guilty individual.

It is to be despisd, as well, in this case.

First of all, let’s stop with the overused, emotional, inaccurate language of “assault weapons.” Do not give me that crap about I “do not need these weapons.” Who, then, makes these decisions as to what, I, a law-abiding citizen needs? Heck, do I also “need” an electric car, solar panels on my house, and my voice as a constitutional conservative silenced?

“A trio of Ohio Republicans have bucked their National Rifle Association backing to lobby for tighter gun control — including a ban on sales of assault rifles — in the wake of Sunday’s mass shooting in Dayton.

Rep. Mike Turner, whom the NRA endorsed with an “A” rating ahead of the 2018 midterm elections, said Tuesday that he now backs legislation that “prevents the sale of military-style weapons to civilians, a magazine limit, and red flag legislation.”

“I strongly support the Second Amendment, but we must prevent mentally unstable people from terrorizing our communities with military-style weapons,” said Turner in a statement. “The carnage these military-style weapons are able to produce when available to the wrong people is intolerable.”

Turner’s 180-degree turn on assault rifles came after he revealed that his daughter and a family friend were in downtown Dayton’s Oregon District early Sunday when Connor Betts, 24, opened fire with an AR-15-style rifle, killing nine people before he was gunned down by cops. “As a result of the police’s actions, my daughter and hundreds of others who were in the Oregon District last night are alive,” Turner said Sunday. “This is an unbelievable amount of evil that we cannot comprehend.”

Gov. Mike DeWine and Lt. Gov. Jon Husted, both of whom were endorsed alongside Turner by the NRA, have also come around on steps toward gun control.

DeWine — who was besieged by mourners’ calls of “Do something!” during a vigil in Dayton — also came out Tuesday in favor of background checks for most gun purchases in his state, as well as restricting firearms access to people perceived as unstable. “We know there’s going to be some violence; it’s the world we live in,” said DeWine. “But I can tell you this: If we do these things, it will matter. If we do these things, it will make us safer.”

Yes, do something. Do something, specifically, to tackle this issue of mentally unstable individuals getting access to weapons. We should be focused on “straw buyers,” a law that is already on the books, and prosecute them.

Last I checked, criminals — and mentally ill criminals — are not concerned about reading laws or following posted signs during the commission of a crime.

With respect to “Red Flag Laws:” this is totally (un)constitutional folks.

It is a violation of the 2nd and 4th Amendment rights of citizens. Sure, it sounds like a great idea, now, just like the Patriot Act and FISA courts did, but this “law” in the hands of the wrong people will end up just like we have witnessed with the misuse of the FISA court system to punish political opposition.

In the future, who will define “disturbing behavior?” During the reign of Janet Napolitano at Homeland Security, there was a report that asserted former military were more prone to be white nationalists and potential domestic terrorists. The last thing we need are progressive socialists developing hidden lists of people — legal, law-abiding gun owners — and targeting them based upon unknown accusers. No one in America is supposed to be guilty before innocent unless you are not a progressive socialist.

Let’s not forget that the Parkland killer had countless call-outs by law enforcement to his home; they did nothing. The schools knew of his disturbing behavior and expulsions, yet, they did not report it, and did nothing. If these incidents had been reported and put into the National Instant Background Checks System (NICS), how many would still be alive today?

The killer in the First Baptist Church shooting in Sutherland Springs, Texas did not have his dishonorable discharge, and domestic abuse charge entered into the system by the US Air Force. Check out BATF Form 4473; those questions are there. He lied, and thus, no “red flag” in the system. But that killer was stopped by Stephen Willeford, a law-abiding, legal gun owner of a semi-automatic rifle, and NRA firearms instructor, who engaged him and ended that tragedy. Yes, an armed citizen protected his neighbors.

Hugo Chavez banned private gun ownership as he came into power in Venezuela under the pretense of curtailing gun violence. Now those unarmed subjects are being starved to death while socialist dictator Nicolas Maduro eats well and orders the military and his armed thugs, his version of Antifa, to gun down innocent citizens.

See, those people, as in all socialist dictatorships, lost their right to keep and bear arms, and therefore they lost all their other individual rights.

As many have stated, an armed individual is a citizen; an unarmed one is a subject. If ANY government demands of me to lay down my weapons and surrender my Second Amendment right to keep and bear arms. my response will be simple: “Molon Labe.” What’s YOURS???

Anti-Gun U.S. Senators Threaten U.S. Supreme Court on New York 2A Amendment Case

US Senator Sheldon Whitehouse of Rhode Island, Mazie Hirono of Hawaii, Richard Blumenthal of Connecticut, Richard Durbin of Illinois and Kirsten Gillibrand of New York have filed an amicus curiae brief to have the Supreme Court dismiss the case of New York State Rifle & Pistol Association, Inc., v. City of New York.

The brief is an amazing example of chutzpah and comes very close to being a direct threat to the Court.

It’s important to remember the history here in that it has been Progressives (Socialists) who have blatantly politicized the Court for the better part of a century. It was Progressives that claimed the Constitution is only what the Court says it is. It was Progressives that claim the Constitution is a living document.

It is the height of arrogance ‘and’ presumption for Democrat senators to chide Conservatives for bringing political cases to the Supreme Court, especially about the Second Amendment.

The first Supreme Court case testing a federal gun control law was Miller.  Miller was a blatant political case brought by an extreme proponent of federal gun control, who was appointed by FDR to the bench in 1933, Democrat Congressman Heartsill Ragon.

A prominent Democrat, Ragon endorsed Roosevelt in 1932 and helped push the New Deal through the Ways and Means Committee. In return, Roosevelt made him a district judge. The NFA was part of Roosevelt’s New Deal program, enacted with broad support shortly after Ragon took the bench. But the Federal Firearms Act of 1938 (sic) was stirring up popular opposition, much of it based on the Second Amendment. The government needed to silence the complaints, and Miller was the perfect vehicle. Ragon had presided in an O’Malley prosecution, so he knew Miller was a crooked, pliable snitch, who wouldn’t cause any trouble. And Gutensohn was a comer who knew the game and got his due. Ragon’s memorandum opinion presented no facts and no argument. With no defense muddying the waters, it was the government’s ideal test case.

The decision in Miller was poorly written. It upheld the Second Amendment as an individual right but was muddy enough that later decisions by appeals courts completely reversed its meaning, creating the myth of the Second Amendment as a “collective right” of government-controlled militias. For 75 years, Progressives dominated the Supreme Court, and the court refused to hear any Second Amendment appeals.

These Democrat, Progressive, senators attempt to chide the Supreme Court for taking a case to prevent actual, obvious, infringements on the Second Amendment.

The Senators note much of the public considers the Court to be highly political. What do Progressives expect, after three generations of politicizing the Court at every turn? Do they expect the public to forget Judge Bork, Clarence Thomas, and the recent attempt to derail Justice Kavanaugh?

The threat to the court is thinly veiled. From the brief:

The Supreme Court is not well. And the people know it. Perhaps the Court can heal itself before the public demands it be “restructured in order to reduce the influence of politics.”Particularly on the urgent issue of gun control, a nation desperately needs it to heal.

The implication is obvious: Nice little Court you have there. Be a shame if something were to happen to it. Rule the way we want, and you may keep your Court.

What Do “Meaningful” Background Checks Mean Exactly? Whatever That Means?

This past week DJT (Donald J Trump), responding to last weekend’s shooting incidences in El Paso, TX, and Dayton, OH, called for “meaningful background checks” to be imposed at a federal level upon any American citizen who wants to make a retail purchase of a firearm.

As I listened, it struck me: “Wait! We already have an instant background check system in place. Our NICS System has been in mandatory operation, nationwide, since 1998!”

Is our current NICS System suddenly “meaningless?”

Imitating his Democrat/socialist opponents, DJT never got specific, never told us exactly what he means by “meaningful” background checks.

Our current NICS System performs a thorough records check of a perspective gun purchaser’s criminal history.

Most felonies, particularly violent felonies, will instantly bounce the application, as will current arrest warrants and protection orders, and documented mental-health deficiencies.

We’re now left to wonder what additional information about an individual is to be added to the NICS-check, in an effort to make it “meaningful!”

Will we now include rumors, speculation, and supposition?

• Will social-media presentations/opinions arbitrarily deemed “inappropriate,” (ie: politically incorrect) now bounce my application?
• Will letters-to-the-editor of local newspapers containing “divergent” opinions, similarly veto my chance to be armed?
• Will my membership in certain organizations, like NRA, GOA, RAC (Rock Against Communism), represent an automatic prohibition?
• Will my use of certain non-government-approved language, like personal pronouns, or my occasionally thinking non-government-approved thoughts, do the same thing?

Gee Mr President, just how “perfect” do I have to be in order to exercise my Second-Amendment rights as an American citizen?

Just how do I go about “proving” to your satisfaction that I’m not mentally ill, nor in another arbitrary category of citizens whom someone has offhandedly decided “should not have guns?”

2^nd Point to Ponder: Presidential Candidate Joe Biden said the following on CNN: Former Vice President Joe Biden called for a complete federal ban on assault weapons and a federal gun buyback program in response to the recent mass shootings in El Paso and Dayton. He told CNN’s Anderson Cooper in an interview which aired Monday night that assault weapons "should be illegal – period," and "the Second Amendment doesn’t say you can’t restrict the kinds of weapons people can own."

3^rd Point to Ponder: In 2016, students in Kansas were given the right to concealed carry of firearms on public college and university campuses throughout the state. Initially, faculty and administrators across the state were vehemently opposed to the new law — roughly 50% of those surveyed worried campus carry would lead to an increase in violent crime on campus.

However, just one year later, an analysis from the University of Kansas Police Department showed that despite initial concerns, overall crimes on campus actually declined by 13% from 2016 to 2017. Additionally, crimes of a violent nature decreased substantially during that same time period, including as 50% decrease in assaults on campus, along with a 66% decrease in robberies and burglaries as well.

It is also worth noting that during the same year, the University of Kansas Police Department had zero arrests for criminal weapons violations, indicating that most, if not all of the guns being carried on campus were in the hands of law-abiding citizens.

Gun Control Quote to Remember: Rep. Cedric Richmond (D-LA), who sits on the House Judiciary Committee, took things to a whole new level when he compared banning so-called assault weapons with banning – brace yourselves – plastic straws.

“I believe that the will of the American people can overpower obstruction in the Senate by the Senate Majority Leader [Mitch McConnell] in terms of bringing bills to the floor to a vote,” Richmond told CNN's Wolf Blitzer. “Assault weapons ban, high capacity magazines that hold the ammunition in these assault weapons and semi-automatic weapons, the overwhelming public wants to see that happen. Think about it. We live in a county where we have cities, right now, that are banning plastic straws but we can’t ban assault weapons? I mean, that just doesn’t make sense to me.”
