Florida Self-Defense: St. Lucie robbery victim acted in self defense when he killed 1, injured another, sheriff says :: 03/02/2016
ST. LUCIE COUNTY -- Sheriff Ken Mascara said the man who killed one robber and wounded a second acted in self-defense early Tuesday in a mobile home park in northern St. Lucie County.
Kyle Davis, 21, fired a 9 mm pistol at about 12:45 a.m. killing Chase Harrington Orvis, 27, after Davis was beaten and pistol-whipped, Mascara said.
The gunfire occurred when three men robbed three other men, one of whom was a resident of Cypress Bay Mobile Home Park in the 6400 block of North U.S. 1, said sheriff's spokesman Bryan Beaty. The wounded suspect was in Lawnwood Regional Medical Center & Heart Institute in Fort Pierce Tuesday. Mascara said the Sheriff's Office was not releasing his name because authorities had not contacted his next of kin as of Tuesday afternoon.
According to Mascara, the third suspect ran away and was last seen crossing U.S. 1. He was described as white and in his early 20s, 5-foot 4-inches to 5-foot 6-inches tall, with short black hair and chin hair, wearing a blue shirt, jeans and glasses.
A resident reported the shooting in the park at 12:45 a.m.
Davis and his friends, Michael Cunningham, 20, and David Quintero, 20, were outside when they were approached by the robbers, the Sheriff's Office said. Quintero is a resident of Cypress Bay.
The suspects frisked Davis and took his wallet and cellphone, but did not find his gun, Mascara said. One of the suspects, armed with a gun, was pointing it at Davis, who was on the ground, he told detectives. Davis lost some teeth from the pistol whipping and possibly a broken nose, Mascara said.
"He was obviously scared," Mascara said. "He wasn't just in fear of his own life, but feared for his friends."
When the armed suspect looked away, Davis pulled out his gun and fired eight times, striking Orvis four times, the Sheriff's Office said. One bullet struck and wounded the hospitalized suspect. Investigators don't know if the at-large suspect was wounded.
Park Manager John Smith said there are about 72 homes in the community. He said he was asleep in his home when he heard six to seven shots.
He said the mobile home park has been a quiet community. "Most people are decent here," he said.
Mascara agreed.
"It's a fairly safe mobile home park," he said. "We can say this was a random act."
