Florida Self-Defense: New Smyrna Beach homeowner shoots intruder :: 02/07/2015

NEW SMYRNA BEACH, Fla. - A New Smyrna Beach homeowner told Local 6 on Thursday that he opened fire and shot an intruder who stole his tools and pickup truck.

The shooting happened around 2 a.m. at a home on Wallace Road, north of State Road 44 near Old Mission Road.

David Como said he was lying in bed, watching TV, when he heard a noise.

"I grabbed my pistol and walked out my bedroom door and there was a man coming toward me, so I shot him," said Como, adding that he used non-lethal rounds.  "It's varmint-load, rat shot, whatever you want to call it.  I had a .44 Magnum right next to me, but I chose to use the non-lethal rounds."

Como said the intruder stole some welders, tools, a chainsaw and his pickup truck, which he used to flee.  Como's pickup was later found abandoned about 9 miles away, Volusia County sheriff's deputies said.

No one inside the home was injured.

"My family is pretty shook up, but I'm alright.  I got grandkids that are shook up, and my daughter and wife are all pretty shaken," Como said.

A search for the intruder, identified by deputies as 32-year-old Larry Graham (pictured, left), was ongoing for hours before he was captured Thursday afternoon.

Officials said Graham nearly ran over a Volusia County sheriff’s deputy while driving away. He was found walking along Park Avenue in Edgewater after hiding in a wooded area near the victim's abandoned truck.

Graham will be charged with armed burglary, grand theft, grand theft auto, aggravated assault on a law enforcement officer and possession of a firearm by a convicted felon.
