Fight for Second Amendment: : Oregon county battles 'unconstitutional' gun laws :: 11/11/2015

Coos County, Oregon has approved a hotly debated measure which allows the county sheriff to ignore gun laws he deems unconstitutional. Voters in the rural Oregon county overwhelmingly passed the gun rights measure with over 60 percent support, reports Fox News.

Citizens at a pro- Second Amendment rally hold up a banner promoting gun owner's rights.

The initiative was placed on the ballot, say supporters, in response to a controversial background check law, which was recently passed by Oregon law makers.

Coos County Sheriff Craig Zanni made it known that he was already leery of enforcing the mandate and the newly passed measure now effectively clears the path for Zanni to defy state and federal gun laws he deems unfit to enforce.
According to the ballot, the measure bars the county from using government resources to enforce any and all "unconstitutional" laws that infringe on the right to bear arms. Further, the measure declares "it shall be the duty" of the sheriff to decide which laws are constitutional and which are not.

Although the measure passed by overwhelming numbers, Zanni predicts the measure will end up in court.
"I'm not sure the courts would agree with that concept," Zanni told the Oregonian. "I would just bet there would be some legal challenges to it."

Ironically, supporters of the measure say they would welcome a legal challenge to the initiative. "One of the reasons we enacted this measure is that we wanted to challenge [the state's] background check law through the judicial process," Rob Taylor, a retired optician and supporter of the measure told The Daily Signal. “We are a big gun ownership area. Coos County has the highest percentage of concealed carry licenses in the entire state,” Taylor continued “They’re tired of having their rights eroded, and not just under the Second Amendment, all of their rights, so they were thrilled that somebody was trying to do something about it.”

The National Rifle Association was quick to praise the ballot's passing, say the measure’s passage reflected a uniform sentiment among U.S. gun owners. “The ordinance passed in Coos County is a sign of the frustration law-abiding gun owners are feeling all across the country.” NRA spokesman Lars Dalseide told The Daily Signal.
