FOAC's Weekly Message For Sunday September 27, 2020 :: 09/27/2020
The past two weeks have seen a flurry of activity in Harrisburg regarding Second Amendment issues and our Constitution.
Two pieces of legislation, HB 1747 and HB 2440, are both poised for passage in the Pennsylvania Senate and awaiting the third reading on the floor.

Another piece of legislation, SR 377, is focused on term limits at the federal level but the process being recommended is a full Constitutional Convention under Article V of the United States Constitution. The proponents believe that a Constitutional convention can be limited but legal scholars and history say otherwise. Sources in Harrisburg tell me that it is unlikely that SR 377 will actually move this session. Further, Pennsylvania is not the only state facing these kinds of actions with Michigan debating this very issue as I write this and nearly every state has some form of legislation under consideration.
Again, why this massive effort with so much money being poured into trying to rewrite our Constitution??
It seems interesting in the extreme that in this troubled time, much of it being promoted and funded by big-money donors, that there is an organization (COS) that is willing to push a constitutional convention without even acknowledging the dangers that these billionaires present to the outcome. There is a companion piece of legislation in the house, HR 206, which also seeks to have Pennsylvania call for a constitutional convention at the federal level.
To build upon the billionaires who are funding the COS (Convention of States) effort, let’s take a look at what the anti-gun group, Everytown, has revealed this past week where they are going to be putting $1.4 million into Pennsylvania elections alone. It’s sadly ironic that they’re calling their candidates “gun sense” candidates when this organization doesn’t know one end of a gun from another, IMHO! More on this later!
Have you ever wondered why so much effort and money is being put into gun control laws when most of those efforts are targeting law-abiding citizens and not the career criminals? When you couple that with how much money is being put into the COS effort it makes one wonder if totally changing the United States Constitution isn’t the real focus of the efforts! What greater impediment to big government and corporations than the statements of our Founding Fathers on Freedom no longer being relevant in a court of law? Remember the arguments that our Constitution is a ‘living document’?
With Pres. Trump nominating Amy Coney Barrett for the open Supreme Court seat vacated by the death of Ruth Bader Ginsburg, the 180° swing in judicial beliefs is causing, what appears to be, a level of desperation in the actions of Democrats. Much of the outrage about Prof. Barrett is outwardly focused on her position on abortion or Obamacare but there is a seething undercurrent of recognition that the Second Amendment may finally get some fair treatment from the Supreme Court!
I have long advocated for gun owners to consider that many times the most important thing when one hears a politician is not so much what they say but what they don’t. So, let’s consider this, all of the anti-gun legislators in DC fear Prof. Barrett because she is an originalist on the Constitution. Here’s what’s not being said, that fear means to me that they have tacitly acknowledged that the Democrats on the United States Supreme Court are not impartial jurist’s but actually activist judges, Ruth Bader Ginsburg being one. Additionally, these activist judges have been making political decisions, and 'not' lawful originalist/textual decisions, on the Second Amendment that are not supported by constitutional language and law! Isn't this a text book description of acting on one's beliefs and 'not' making decisions based on the Constitution? Again, THIS is what scares the DC elite, that Prof. Barrett will make the 'right' and not the 'personal' decision on the Constitution! We've suffered long enough with Justices who speak out of both sides of their mouth and pay lip service to their duty!

Yesterday, the Commonwealth Court issued a notice scheduling En Banc (meaning before the entire Court) oral argument in Firearm Owners Against Crime (FOAC), et al., v. City of Pittsburgh, et al. in relation to Pittsburgh’s illegal firearm ordinances, which I was previously successful in having ruled unlawful. As our viewers may remember, in November of last year, the City of Pittsburgh took an appeal to that decision.

Biden Uses Tragedy to Push Assault Weapon Ban Lies - Crime Stats Show He Is Wrong!
With the attempted assassination of two Los Angeles sheriff’s deputies, on Saturday, Joe Biden warned, “Weapons of war have no place in our communities." And within just hours of the attack, Biden tweeted praise for the original ban on assault weapons and standard-capacity magazines, which lasted from 1994 to 2004. “These bans saved lives, and Congress should never have let them expire,” Biden thundered in his Tweet.
His vitriol ‘might’ have been understandable IF ANY of his conclusions were even remotely true – they aren’t!
A handgun, not a so-called assault rifle, was used to shoot the deputies. But it seems that Biden never misses an opportunity to deceptively complain about “weapons of war.”
In the past, Biden and vice presidential nominee Kamala Harris have ‘both’ applied this label to AR-15 semi-automatic rifles.
What about Biden’s claims that the assault weapons ban saved lives?
Since the ban expired in September 2004, murder and overall violent crime rates have fallen. In 2003, the last full year before the law expired, the U.S. murder rate was 5.7 per 100,000 people. The murder rate never returned to that level, and fell to 5.0 per 100,000 people by 2018.
If the ban had any effect, one would think that it would reduce the number of murders committed with rifles. But the percentage of firearm murders that were committed with rifles was at 4.8% prior to the ban starting in September 1994, and averaged 4.9% from 1995 to 2004. In the 10 years after the ban, the figure averaged just 3.9%. This pattern is the opposite of what gun control advocates predicted.
Many academic studies have examined the original federal assault weapons ban. Clinton administration-funded research by criminology professors Chris Koper and Jeff Roth confirmed as much in a 1997 report for the National Institute of Justice. “The evidence is not strong enough for us to conclude that there was any meaningful effect (i.e., that the effect was different from zero),” they wrote. Koper and Roth suggested at the time that it might be possible to find a benefit after the ban had been in effect for more years. In 2004, they published a follow-up NIJ study with fellow criminologist Dan Woods. “We cannot clearly credit the ban with any of the nation’s recent drop in gun violence,” they concluded. “And, indeed, there has been no discernible reduction in the lethality and injuriousness of gun violence.”
Gun control advocates often justify their positions because of work by Louis Klarevas, but his non-peer-reviewed methodologies have been challenged by Dr. John Lott. While the share of mass public shootings that utilized assault weapons fell during the ban, it fell even more sharply in the 10 years AFTER the ban ended in 2004.
Biden is making it clear that gun control is near the top of his agenda. But no matter how much Biden (the proverbial ‘Wizard of Oz’) wishes it were true, guns bans won’t make American’s safer.

Here’s just One Sample: On 9/21, the political wing of the virulently anti-gun group Everytown for Gun Safety launched a $1.4 million digital advertising and direct mail campaign targeting a dozen state House seats, mostly in suburban Philadelphia, and a quartet of Senate seats, to flip the General Assembly to a "gun sense majority."

The Trump Administration and AG Barr Are Putting the Squeeze on Violent Firearm Felons! Crickets from the Media!!
For decades, FOAC has been pointing out the connection between liberal and lenient Democrat policies and violent armed thugs, especially in the urban centers in PA. At the same time, these very same Democrats have gone to great lengths to punish Americans for exercising their Second Amendment rights all the while ignoring career criminals breaking the law and carrying out violent crimes with firearms.
Billionaire Michael Bloomberg has dumped hundreds of millions of dollars into states across the country, successfully limiting the ability of law-abiding citizens to fight back against those who want to do them harm. Through his gun control lobbying organization, Everytown and their state affiliate CeaseFire PA, Bloomberg has made it harder for women to defend themselves against domestic abusers, stalkers and easier for criminals to prey on the innocent.
Everytown, CeaseFire PA, Mom’s Demand Action and other anti-rights groups conveniently target law-abiding citizens because it's easier and cowardly while they refuse to do the hard, dangerous work of going after violent criminals illegally using or possessing firearms. In point of fact, their public statements are virtually ALL geared towards blaming the law-abiding citizen.
Through Operation Legend, which was implemented earlier this year, federal law enforcement agencies have aggressively gone after those who federal prosecutors call "the trigger pullers" and have taken hundreds of illegal firearms off of the streets. They're also going after those who knowingly and illegally sell guns to criminals.
These efforts have led to a substantial decrease in violence carried out by criminals using guns. In Chicago, the murder rate has been cut in half since July thanks to federal efforts to take bad guys off the streets. In total, Operation Legend has resulted in the arrests of 2000 individuals for serious crimes, 592 of them have been charged federally. Nearly 600 illegal firearms have been seized.
This is a substantial change from the previous administration. Under Attorney Generals Eric Holder and Loretta Lynch, federal prosecutions against those using firearms to carry out crimes plummeted. The result was more innocent victims and increased crime in America's most vulnerable communities.
"While President Obama decries gun violence and presses for more laws to restrict ownership, his Justice Department has prosecuted 25 percent fewer cases referred by the main law enforcement agency charged with reducing firearms violence across the country, a computer analysis of U.S. prosecution data shows," the Washington Times reported in 2014. "Federal prosecutors brought a total of 5,082 gun violation cases in 2013 recommended by the Bureau of Alcohol, Tobacco, Firearms and Explosives, compared with 6,791 during the last year of George W. Bush's presidency in 2008, according to data obtained from the Executive Office of U.S. Attorneys. The 2013 totals represent a 42 percent decline from the record number of 8,752 prosecutions of ATF cases brought by the Justice Department in 2004 under Mr. Bush, according to the data."
The Trump Administration and AG Barr are attacking gun violence at its’ source by applying the law and putting bad people in prison. Wonder who gets the credit for it? Yeah, we know!

Trigger Discipline
Part 2 in a multiple part series on the Safe and Proper use of your defensive tool
The cornerstone of all firearms training, no matter the context is safety. All Americans who exercise their 2A Rights must also exercise them responsibly; this begins with safe gun handling.
Many training organizations have various “Safety Rules” that if followed will prevent someone hurting themselves or someone else. A firearm is like a hammer or a chainsaw, it, on it’s own, is incapable of inflicting harm. However, just like a hammer or a chainsaw, in the hands of a person who is ignorant, physically incapable, undisciplined, or criminally inclined, then that PERSON has the potential to pose danger to themselves or those around them.
Although it is good to know the parts and nomenclature and basic operations of your firearm, you don’t have to be a junior gunsmith to be able to handle a gun safely. The 2 most important “gun parts” to know is the muzzle and the trigger. This article I will discuss the Trigger and Trigger Discipline.
99% of all guns that you will see in real life, in a movie, in a museum or on the range have a trigger. The trigger is the lever that is designed to be pressed by your trigger or index finger and facilitates the firing sequence. It is what makes the gun go “bang”. All of the national training organizations have a safety rule to address this:
NRA: ALWAYS keep your finger off of the trigger until you are ready to shoot.
USCCA: keep your finger off of the trigger and outside the trigger guard until you are on target and made the decision to shoot.
I.C.E. Training: Keep your finger somewhere other than the trigger until you are ready to shoot.
Nowhere in nature do we pick up or handle an item or object while isolating our index finger from the rest of our digits. “Trigger Finger Discipline” is a learned skill and we, as responsible gun handlers must be “disciplined” to do it all of the time… every time. It takes practice to master this. The ONLY time we make physical contact with the trigger is when we want to make the gun go bang.
It is important to recognize that the majority of time that we are handling a firearm; cleaning it, putting it into a holster, admiring it, inspecting it, transporting it, putting it away, picking it up, presenting it from a holster, passing it to a friend, holding it at a ready position, loading it, unloading it, retrieving it from a lock box, clearing a malfunction, cocking it, de-cocking it…. your finger SHOULD BE somewhere OTHER than on the trigger.
I recommend finding a tactile index point on your firearm that you can consistently keep your trigger finger when not shooting. On a semi-auto pistol, most folks can feel the ridge where the slide and frame meet, or perhaps the bump where the backside of the take down lever protrudes from the frame. Perhaps feeling the cylinder of a revolver against the top of the trigger finger… Find that spot, that you can consistently “feel” so that you don’t have to look where your finger is, you just know it is in the “safe” spot. Keep your finger there…. And move it to the trigger only when you are ready to shoot.
It is not enough to simply keep your finger off of the trigger. The trigger finger must be HIGH above the trigger guard. One of the body’s natural reactions to a surprise stimulus or if you slip or loose your balance is that if you are holding something, you will likely clinch your fists and “grasp” whatever you are holding. If that is a firearm, and you finger is near the trigger guard, you will likely slip the index finger into the guard and perhaps put your “booger hook on the bang switch”. This could facilitate a negligent discharge with potentially life changing consequences.
So, when do we ACTUALLY touch the trigger? When are we really “ready to shoot”?
We should ONLY touch the trigger when we have positively identified our target, we have made the conscience decision to put a hole or holes in said target, and we are in a shooting position. Until then, we are not truly ready to shoot. Too often in square range training we loose sight of the fact that we must positively identify our targets. We often get into a rhythm of administrative hole punching as we are stare down our paper targets like Gary Cooper at High Noon. (younger folks may want to Google Gary Cooper, High Noon). The cognitive process of target identification is often dismissed or assumed. We, the law abiding armed American Citizen, do not get to pick when and where we are attacked by a violent criminal. Frankly if we KNEW we were going to get jacked up at the grocery store today… we wouldn’t go to the grocery store. A Dynamic Critical Incident will likely be chaotic and confusing. We MUST learn to only touch the trigger once we have identified the attacker, we have made the choice to defend ourselves against it, and when we are in a shooting position.
Unfortunately, this is a lot to consider when seconds count during an attack that we didn’t start and could not get away from, but it is part of our duty as responsible gun owners to consider it. This should further emphasize the importance of training. Remember, the 2nd Amendment has 2 components: Armed and Well Regulated. Seek out training, learn to run your gun efficiently and intuitively.
Lastly, as I wrap up this installment, consider one more rule, “The Big Picture Rule”. Every time you pick up your gun, consider this:
Recognize that YOU are in control of a firearm, if YOU use this firearm carelessly, ignorantly, or with malice, YOU have the potential to harm or kill yourself or someone else.
Act accordingly. Don’t just be an armed American, be a responsibly armed American!
Stay armed, alert, safe, and be well regulated!

Remember all the so-called Media Geniuses who said that the new Brazilian President’s Effort to relax gun laws would lead to ‘blood in the streets’?
The recent election of Brazil’s President Bolsonaro presented him the opportunity to fulfill one of his campaign pledges which was to ease gun regulations and let more people own guns. The media and the “experts” wrung their hands in desperation openly proclaiming that it would lead to more homicides/murders.
Funny thing that; it didn’t turn out that way. While results are still early and other factors have to be accounted for, violent crime in Brazil has plummeted sharply but don’t expect to see these so-called doomsayers, who were clearly predicting disaster, admit that they were wrong.

Just like in America, these so-called experts fail to see (or intentionally ignore) the clear facts that it is their utopian view of a controlled world that results in more death. Empowering people to stand up to thugs in society always works because government simply cannot protect its’ citizens – thus the 2nd Amendment.

FOX Reporting: Police obtained a no-knock warrant for Breonna Taylor’s apartment. Just before they left the police station, they decided to do a knock-and-announce instead. A neighbor testified that the police did indeed knock and announce before forcefully entering the apartment. Taylor’s boyfriend, Kenneth Walker, opened fire on the police, striking one officer in the thigh. The police returned fire, accidently killing Taylor. The city settled a wrongful death suit with Taylor’s family for $12 million.
CNN Reporting: The police executed a no-knock warrant on Breonna Taylor’s apartment. They forcefully entered the residence and shot Taylor to death.

Pennsylvania Supreme Court Judges Undermine PA Election Law
Pennsylvania was recently the subject of a federal court ruling that found the Governor Wolf’s onerous shutdowns violated the Constitution. It was a win for Rule of Law. Unfortunately, our state’s Supreme Court just delivered the opposite result, rewriting state laws about ballot counting in such a way that will likely undermine the 2020 election.
Despite state law requiring that mailed ballots be received by 8:00 p.m. on Election Day, the state Supreme Court, by a slim 4-3 leftist majority, opted to rewrite the law less than seven weeks ahead of the election. “There is no ambiguity regarding the deadline set by the General Assembly,” the court’s four-judge majority correctly noted, but they then cited the state’s constitution to undo that law: “Elections shall be free and equal; and no power, civil or military, shall at any time interfere to prevent the free exercise of the right of suffrage.”
The trouble is that line does not empower judicial activists to overturn state law that in no way violates the state’s constitution.
After this ruling, ballots must still be counted even if they don’t have postmarks, and even if they don’t arrive until November 6 — three days after the election. In fact, voters don’t even have to put their ballots in the mailbox until Election Day, and if the Electoral College is to be decided by Pennsylvania, Americans won’t know the winner of the presidential election for several days or even weeks if legal wrangling ensues.
Philadelphia has quite the history of voter fraud already, and the state’s Supreme Court just opened the door wide for more shenanigans. Clearly, the radical Left’s 2020 agenda — now aided by four judges in the Keystone State — is undermining Americans’ faith in our electoral process.
Elections have consequences my friends and we, gun owners, sat on our hands (just like Virginians did last year) in the 2013, 2015, and 2017 Judicial elections. ‘This’ is the result of apathy and how Freedom is lost (or stolen). Please don’t let this happen in 2020!

How Freedom Dies:
In 1984 ex-KGB officer and Soviet defector Yuri Bezmenov taught us about the Marxist plan for what they called ideological subversion. The term is foreign to most Americans. In a nutshell, it is the slow process of changing the perception of reality of Americans when it comes to the right to defend themselves, their community, their family, and their country. The communist laid out their diabolical plan in four phases.
These anti-gun groups follow this plan at every opportunity! They ignore the writings of Madison. They ignore the Federalist papers. They have to, or their arguments fall apart. They say the Second Amendment only applies to the militia. Well, guess what? We are the militia! I am the militia. Their anarcho-communist plan will never succeed as long as good men and women can throw off the chains of slavery through armed defiance. They have to disarm us for their plan to succeed, and I, for one, will never be disarmed. I will not give up my freedom for imaginary safety. Will you?
Closing Thoughts: The Story of Jake Gardner (Marine)
A former Marine and decorated Iraq War vet, Gardner owned a bar in Omaha, Nebraska. He was inside his bar when BLM thugs attacked. They broke his windows and then invaded his bar. He feared for his life. He reported feeling like he was back in Iraq, in the middle of a war zone.
Gardner pulled the fire alarm, called the police and then went outside with his father to escape the violent mob invasion of his business. His father was attacked, knocked to the ground. Gardner tried to help his father. He struggled on the ground with attackers, fired two warning shots and then fired a third, killing a violent thug. This was the clearest case of self-defense by a business owner in history.
The DA cleared Gardner and declared it a case of self-defense. The video of the incident confirmed it was self-defense.
But the BLM mob wasn't happy. After weeks of protest, a "special prosecutor" was named. Frederick Franklin, a crusading liberal prosecutor with clear bias against Trump supporters, charged Gardner with manslaughter, use of a deadly weapon to commit a felony and making terroristic threats.
Can you imagine? Liberals think defending your life and property from violent thugs makes a Marine war hero into a "terrorist." Gardner received hundreds of frightening death threats. A judge issued a warrant for his arrest.
Finally, being desperate, overwhelmed, no doubt suffering from PTSD, scared of never getting a fair trial and of being murdered in prison, this hero vet and business owner committed suicide a few days ago.
Jake Gardner is dead. But DON’T call it suicide. This was murder. A Marine war veteran was murdered by liberals, Black Lives Matter and another vile, vicious, prejudiced prosecutor - Frederick Franklin.
How could America treat a hero Marine and business owner like this? The media ignores this! The DC beltway insiders brushed this aside as if it is just another footnote in the list of tragedies.
We should all be ashamed. Our blood should be boiling. This could have been any one of us. It could have been any of our sons.
