FOAC's Weekly Message For Sunday June 28th 2020 :: 06/28/2020
With confirmed reports coming in that as many as 2-million Americans have purchased their first gun in just the past six months, some folks are starting to think about the impact that these new Second Amendment enthusiasts could have on the November elections.
As much as I’d love to think that every new gun owner is going to turn into a voter who will prioritize Constitutional Freedoms over party politics, you and I both know that isn’t going to be the case. There will be plenty of left-leaning new gun owners who cast their votes for anti-gun Democrats in November, even if they now object to a candidate’s position on the Second Amendment.
It is my fervent hope that these new gun owners (along with some current ones) will not only come to understand the importance of voting to protect their Right to Keep and Bear Arms sooner rather than later, but that they’ll push Democrats to undo the damage done by gun control laws.
New gun owners in California who’ve now been exposed to the absurdities of the state’s gun control regime could also have an impact on some races, though it’s probable that Biden will still win the state handily. In swing districts, however, new gun owners could help tilt races for the state Assembly and state Senate.
In other words, I think the influx of new gun owners could very well play a key role in deciding some elections, but increased political activism by the nearly 100-million Americans who’ve owned firearms for years could have an even bigger impact. Regardless of when you became a gun owner, it’s critically important that you vote like your rights depend on it this fall, because they absolutely do. Increased gun ownership on the Left may help defuse or undo gun control legislation over the long-term, but in the near future, Democrat control of Congress and the White House would lead to a gutting of the right to keep and bear arms for all of us-just look at what has and is happening in Virginia.
How long can this nation survive when our main cultural and educational institutions preach a relentless, unchallenged stream of anti-Americanism to young people?
One can hardly turn on the news without seeing what appears to be our country imploding before our very eyes, and it seems as though little to nothing is being done about it. We see non-stop protests that seem to have ever more radical demands, vandalism and destruction that is not only allowed but almost encouraged and at the same time, our elected officials seem hell-bent on restricting the ability of the police, those who stand between us and the madness while ignoring the destruction and cultural shift going on right in front of us.
A growing chorus of voices are arguing that the American left has a major problem with America as founded. Yet Democrats are outraged by the suggestion, and too many Republicans seem insufficiently concerned about it. They better wake up.
Please consider the following data presented by Eric Kaufmann, professor of politics at the University of London Birkbeck College.
Kaufmann writes that the "cultural revolutionaries" who are toppling statues and renaming buildings "are changing minds, and could be in a position to enact a root-and-branch reconstruction of America into something completely unrecognizable to its present-day inhabitants." He adds: "Imagine a country whose collective memory has been upended, with a new constitution, anthem, and flag, its name changed from the sinful 'America' to something less tainted. Far-fetched? Not according to data I have collected on what liberal white Americans actually believe."
Notice Kaufmann isn't talking merely about the extreme left but American liberals. This is chilling stuff.
On May 7 (before the tragic George Floyd killing), he surveyed a sample of 870 Americans who "lean young, liberal, and white." The group was not representative of the American population at large but drawn from the Amazon Mechanical Turk and Prolific Academic survey platforms used by thousands of academics. He consciously removed conservatives and centrists to focus only on self-described liberals. He presented them with 16 "outlandish" statements and was "amazed" by their answers. He surveyed them again on June 15, after the Floyd killing and subsequent protests, and found that things "had gotten even crazier."
Kaufmann reports: "Every one of these proposals represents a radical blow to American cultural nationhood. Yet ... six of them carry the support of more than 50 percent of committed liberals ... Eight are backed by a majority of the 40 percent of liberals who identify as 'very liberal.' Some 80 percent of those who have made up their mind would replace the national anthem and constitution."
Assuming this survey is remotely scientific and representative of liberal thinking, it should be uncontroversial to say the American left wants to radically transform America.
After considering this data, and the left's support and sympathy for the violence, looting and anarchy sweeping this country, could it be any clearer what is at stake in the 2020 elections?
PA House Passes HB 1747 Removing Draconian Powers of the Governor and Mayors to Suspend Civil Rights/2nd Amendment
FOAC wishes to thank Representative Matt Dowling and all the members of the House of Representatives who supported HB 1747! This legislation has been a focus of FOAC for nearly 4 (four) years and our desire to see this moved increased with the recent Emergency Declarations. Passage of this legislation will remove very onerous very onerous language in a section of PA law, in Title 18's Uniform Firearms Act, that currently disarms EVERY PA Citizen who does not have a License To Carry Concealed Firearms (LTCF) during declared Emergencies. The portions of Sections 6107 and 7301 that HB 1747 seeks to remove are unconstitutional, as they prohibit law-abiding individuals from being able to exercise their constitutional rights and defend their lives. The curtailment of constitutional rights is never authorized, especially in a time of emergency, when the exercise of those rights is of paramount importance.
Recently, PA Supreme Court Justice Wecht, joined by Justices Donohue and Dougherty, recently wrote, "In light of the regulatory framework attending the sale and transfer of firearms, the inability of licensed firearm dealers to conduct any physical operations amounts to a complete prohibition upon the retail sale of firearms—an activity in which the citizens of this Commonwealth recently have been engaging on a large scale, and one guaranteed by both the United States Constitution and the Constitution of this Commonwealth.” The opinion goes on to explain that the restriction on the ability to purchase a firearm at a Federal Firearms Licensee "amounts to an absolute and indefinite prohibition upon the acquisition of firearms by the citizens of this Commonwealth—a result in clear tension with the Second Amendment to the United States Constitution and Article I, Section 21 of the Pennsylvania Constitution.”
Restricting a citizen’s right to self-defense as well as the lawful exercise of their 2nd Amendment/Article 1, Section 21 rights, under the US and PA Constitutions, cannot and should not be condoned and HB 1747 addresses these issues definitively! The Governor’s issuance of his opioid proclamation(s), as well as, a state of emergency regarding COVID-19; pursuant to 18 Pa.C.S § 6107, prohibits an individual from carrying/possessing ANY firearm on “public streets or upon any public property” during the state of emergency, unless one has an LTCF.
Further, the public has been misled as to the consequences of a violation of 18 Pa.C.S § 6107 because pursuant to 18 Pa.C.S. § 6119, it is a misdemeanor of the first degree – our highest grade misdemeanor. As a result, if an individual would be convicted of a violation of Section 6107, it triggers the federal prohibition of 18 U.S.C. § 922(g)(1); whereby, that individual will be prohibited for the remainder of his/her life from possessing (current firearms) and purchasing any firearms and ammunition.
It is important to remember, this IS CURRENT LAW right now and HB 1747 will ‘repeal’ the problematic sections of law thus shrinking the power of government to violate civil rights and our Constitutions, both state and federal.
Gun control organizations such as Everytown, Mom’s demand action, and cease-fire PA are on record supporting continuing the framework of denying civil rights and the right to self-defense to millions of Pennsylvania citizens and placing them in legal jeopardy. The misleading rhetoric coming from these gun control organizations reveals that they have no respect whatsoever for the constitutional rights of law-abiding citizens to protect themselves or those whom they love.
Pennsylvania is the 11th most restrictive state in the nation for the exercise of the Second Amendment rights of law-abiding citizens. We have a vast array of laws that currently exist covering every aspect of firearms ownership, acquisition, and possession. While we question the veracity of many of those laws this is one law that the public in this debate can do without.
SCOTUS Ignores the Second Amendment ... Again
The Supreme Court has, once again, declined to hear challenges to state- and local-government infringements on the “right of the people to keep and bear arms,” which is indeed the “First Civil Right” of all law-abiding Americans, as enshrined in our Constitution’s Second Amendment.
The great irony of the High Court’s silence on these challenges is that, as our Constitution’s most noted scholar and jurist Joseph Story wrote in his exhaustive Commentaries on the Constitution of the United States (1833), “The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of the republic; since it offers a strong moral check against usurpation and arbitrary power of the rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them.” In other words, the Court has refused to take up cases essential to the protection of the founding document that empowers the courts.
In their dissenting opinion regarding the SCOTUS denial to consider these cases, Justice Clarence Thomas, with Justice Brett Kavanaugh, wrote:
“The text of the Second Amendment protects ‘the right of the people to keep and bear Arms.’ We have stated that this ‘fundamental righ[t]’ is ‘necessary to our system of ordered liberty.’ Yet, in several jurisdictions throughout the country, law-abiding citizens have been barred from exercising the fundamental right to bear arms because they cannot show that they have a ‘justifiable need’ or ‘good reason’ for doing so. One would think that such an onerous burden on a fundamental right would warrant this Court’s review. This Court would almost certainly review the constitutionality of a law requiring citizens to establish a justifiable need before exercising their free speech rights. … But today, faced with a petition challenging just such a restriction on citizens’ Second Amendment rights, the Court simply looks the other way.”
“It appears that a handful of States throughout the country prohibit citizens from carrying arms in public unless they can establish ‘good cause’ or a ‘justifiable need’ for doing so. The majority of States, while regulating the carrying of arms to varying degrees, have not imposed such a restriction, which amounts to a ‘[b]a[n] on the ability of most citizens to exercise an enumerated right.’ The Courts of Appeals are squarely divided on the constitutionality of these onerous ‘justifiable need’ or ‘good cause” restrictions.’ One of this Court’s primary functions is to resolve ‘important matter[s]’ on which the courts of appeals are ‘in conflict.’“
But the justices failed to do so, as they have for the last decade. As we have noted many times before, the future of American Liberty rests on the composition of the federal courts. The Supreme Court is now generally divided between those who abide by their oaths ”to support and defend“ our Constitution and act accordingly and those who endeavor to rewrite our Constitution. And correcting that divide rests on the reelection of Donald Trump and retaining the Republican Senate majority, as the next president will have one or two SCOTUS nominees who will finally shift the balance of the High Court back to its constitutional authority and mandate.
Do You REALLY Think Your Firearm Ownership is Private? 6-Ways They are Tracking You
One of the ever-present threads that I have frequently experienced in conversations with gun owners is that they don’t want to get involved in the gun rights movement for ‘fear’ of being tracked by government. Two justifications, along those lines, stand out the most from my interaction with them. One is lethargy, often associated with the notion that “they are not after my kind of gun.” The other is a fear of being a target of radical gun prohibitionists enforcing some sort of gun ban. I will address each of these here, pointing out possible flaws with each position.
My Gun Is Safe
Adherents to this notion have believed that the gun grabbers were not interested in their particular type of firearms hardware. Gun owners have historically been divided into several groups, with often overlapping edges. You have hunters, target shooters, plinkers, and defensive carriers; each group with their own interests. Hunters may only fire a handful of shots each year, a few sighting in shots at the beginning of the season, and then what’s necessary to take their chosen game. This group has been derogatorily labeled by some as Fudd’s after Elmer Fudd, of Looney Toons fame.
Well now, we’ve all heard that Elmer has had his gun banned. Instead, he is left with the Grim Reaper’s scythe. So maybe your double barrel is not safe, nor that old bolt action. After all, bolt action rifles are the “sniper’s weapon of choice“.
They are not after your hunting gun now, but as other states have shown, they’ll get ‘round to it.
Out of Sight, Out of Mind
Others adhere to the notion that if they keep a low profile, they are safe from the gun grabbers. Let’s explore this low-profile idea.
In many jurisdictions, private sales are perfectly legal. Some gun owners are very careful to only purchase their firearms this way, in an attempt to stay away from the purview of officialdom. Maybe that’ll work, maybe not, and we know for sure that private purchases do NOT involve handguns here in PA.
Your papers, please.
So, you don’t want to register your guns; and although NICS records are purported to be destroyed after the transaction (who knows for sure) here in PA we KNOW for a FACT that a Record of Sale Database of Pennsylvanians exists and has done so since 1901! You know, that RIGHT?? If you have bought them all in private sales, you may be safe to a point. But are you a registered gun owner? Have you unwittingly gotten on a list?
Here are seven (7) actions that will (or are likely to) put you on one.
- Do you have a state-issued handgun permit? You’re on a list.
- Do you get any firearms-related publications? Informed Delivery may not be your friend.
- Do you order any parts or accessories online? There’s a record.
- Do you use a debit or credit card to buy ammo? Hmm… we have seen how pro-gun banks can be.
- Do your FedEx or UPS ammo deliveries have HAZMAT labels? Everybody knows what’s under the plain brown wrapper.
- Do you shop locally and pay with cash, but your dealer has video surveillance?
- What is in your social media profile and your comments across the net? Have you ever heard of Google’s Way Back Machine? NOTHING is deleted from the net!
How difficult would it be for a rogue gun-grabbing government agency to build a dossier on you utilizing today’s technology?
So, unless you live further off the grid than Randy Weaver did, staying on the down-low just may not work.
How’s that Non-Existent Voter Fraud Working Out?
How many times have we been told that election fraud really doesn’t happen in the US or at least not in such a way that it could really impact the integrity of our elections? That’s something liberals have said for years to dismiss conservatives’ concerns about fraud, while a good chunk of these folks also still think Russia altered ballots in the 2016 election. Is it rare? Yes, but efforts to enhance election security have always been opposed by Democrats.
This story is crazy -- mail-in ballot fraud at the highest levels of a N.J. city. Also, 10% of ballots in 31 different N.J. municipal elections last month were rejected, all vote-by-mail elections.
In fact, the N.J. Attorney General is charging four people with fraud including the Vice President of the City Council and a candidate for that body. To top it off, this is over who will control the city council of Paterson. It’s become so bad that the local NAACP is calling for the election to be invalidated. Mark Hemingway (of Real Clear Politics) quoted a law professor who admits that there is an absentee ballot fraud scheme being executed in Paterson. Also, there are multiple lawsuits across the country being filed concerning how mail-in ballots are verified.
This was just a city council race. Imagine what the chaos would be if hundreds of millions of ballots were mailed out. Would Democratic states verify the results fairly?
Recently, there was an oversight report that showed the government doled out $1.4 billion in COVID relief payments to dead people. Again, it undercuts this nationalized vote-by-mail scheme that Democrats are pushing. If you wanted voter fraud to skyrocket, then this is your system, apparently. Oh, and while there’s no evidence of fraud, we’ve lost some 28 million ballots in the past four elections. So, if fraud doesn’t give you pause over this vote-by-mail narrative, then the system just being shoddy should give you some pause.

From the Land of Fruits & Nuts: California’s Anti-Gun Governor Wants to Ban a Gun That’s Not Sold in California AND they Don’t Even Know What it is!!!
California lawmakers this week are readying a budget maneuver to ban a new type of gun in a move that drew bipartisan criticism in a legislative committee hearing Wednesday evening.
Gov. Gavin Newsom’s administration describes the firearm as an assault-style weapon that’s a cross between a rifle and a pistol. It doesn’t neatly fit into either category, however, because it lacks a shoulder stock needed to be a rifle and has a barrel too long to be a pistol.
Representatives for Newsom argued at a Senate Budget Committee hearing that the gun was designed to circumvent California gun control laws and that the policy change would close the ‘dreaded’ loophole.
To justify all of this, the Governor’s representative Aaron Edwards testified that “The longer we wait, the more people may be able to obtain these weapons,” Edwards said. “We think that they’re a public safety threat and we feel there’s an urgency to act now.” In other words, it’s not an “assault weapon” under California law, but the governor wants to define it as one anyway because HE feels like that’s what it should be called.
With an anti-gun supermajority in the state legislature, Newsom could easily get a standalone bill banning the gun approved, but enforcement of the new law wouldn’t take effect until January 1st of 2021. If the gun ban provision is included in the state budget, the Franklin Armory Title 1 would be illegal for sale in the state starting in just a few days, on July 1st.

FBI Corruption/Political Bias Real or Not – YOU Decide
The FBI attorney, Kevin Clinesmith, whose altering of an email led to an unconscionable and intentional manipulation of a FISA surveillance warrant application on Trump 2016 presidential campaign associate Carter Page is no longer with the FBI.
After Trump was elected in November 2016, Clinesmith wrote an e-mail to another attorney, “I’m just devastated.”
“I am so stressed about what I could have done differently,” Clinesmith wrote. “I just can’t imagine the systematic disassembly of the progress we made over the last 8 years. ACA [the Affordable Care Act] is gone. Who knows if the rhetoric about deporting people, walls, and crap is true. I honestly feel like there is going to be a lot more gun issues, too, the crazies won finally. This is the tea party on steroids. And the GOP is going to be lost, they have to deal with an incumbent in 4 years. We have to fight this again. Also Pence is stupid.”
What is the background of former FBI Clinesmith in addition to manipulating the FISA court? Take a look at his other connections:

Interestingly, Clinesmith’s DC Bar license is in good standing with no disciplinary actions on file, according to the DC Bar website. Hmmm…..??
PA Attorney General Shapiro Joins 15 Other Anti-Gun States in Calling for Mandatory Background Checks for Ammunition
New, burdensome gun control laws may be going to impact many Pennsylvanians if PA AG Josh Shapiro (running for reelection this year / Think Heather Heidelbaugh) is able to impose his twisted pretzel logic on the Keystone State’s gun owners!
Shapiro has signed Pennsylvania onto the anti-gun coalition including Illinois, Connecticut, Delaware, the District of Columbia, Hawaii, Maryland, Massachusetts, Michigan, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Virginia, or Washington by giving the green light for our state legislature to implement California-style ammunition control if they want.
California’s law requiring background checks on every purchase of ammunition has been a gigantic clusterf**k since it took effect back in 2018. Since then, tens of thousands of Californians have been denied the ability to purchase ammunition because of problems with the government’s database of gun owners, while others have had to wait through lengthy delays to simply purchase a box or two of ammunition.
Back in April, a federal judge issued a stay on enforcement of the law, but the Ninth Circuit Court of Appeals quickly overruled the lower court, and the law remains in effect for the time being, though the case (known as Rhode vs. Becerra) is still actively being litigated.
First, there’s no other state in the country that requires background checks on ammunition sales, though the requirement was part of the SAFE Act signed into law in New York in 2013. The New York State Police never figured out how to actually conduct the background checks, however, and in 2015 Gov. Andrew Cuomo suspended the requirement due to the failure of his administration to find a way to implement the law.
Considering how the PA Instant Check System is, and has been, increasingly malfunctioning (at times severely) it is going to make ‘any’ background checks even MORE problematic. The impact on hunters, competition shooters and reloaders is STILL up in the air.

NEVER Forget: The anti-gun group Coalition to Stop Gun Violence made this statement in an e-mail on 6/26/2020: At the Coalition to Stop Gun Violence (CSGV), we know that police violence IS a form of gun violence. In fact, we believe -- in many ways -- that it is a root cause of gun violence. We also recognize that the lasting effects of COVID-19, ongoing social unrest, and a lack of trust in law enforcement are going to exacerbate the social and health inequities that are already deeply embedded in this country. (So, does this mean that CSGV will push to disarm Law Enforcement now?)
The CSGV e-mail then goes on to connect ‘Stand Your Ground Laws’ as an excuse for murder. Of course, there is no documentation of legitimate examples to substantiate their points except for an article in Ohio railing against the proposed Stand Your Ground law under consideration there.

2nd Point to Ponder: History is full of turning points and conflict, most don’t seem to ever get remembered in the rush to recall which NFL team has the best chance of getting to the Superbowl or what celebrity just got married or divorced, and that very well may be our problem. We’re forgetting that history is cyclical and that despite the warnings of the past, we forget to heed the danger of the present. We’re seeing America fall apart before our very eyes, make no mistake about that. We need to come together and demand that the nonsense stops and that our elected officials in both parties know that we are watching and that the rule of the mob must not dictate policy or make laws out of fear, for if we give in to those who threaten that things are changed or else they face the wrath of the crowd, then every group will realize that the ballot box no longer means anything and instead air grievances with bricks and Molotov cocktails.

IF you are already aware of the Civilian Marksmanship Program then you are probably aware that the Camp Perry Annual Matches are a fixture among many rifle shooters who make the pilgrimage every summer. These Camp Perry Matches have been cancelled unfortunately BUT the Reade Range has scheduled some Replacement Matches in place of the Camp Perry Matches for July 25-28.
Law Enforcement on Guns:
This week, a general call to arms has been echoed by Polk County Sheriff Grady Judd and Volusia County Sheriff Mike Chitwood, who spoke to the Fox affiliate in Orlando about his support for the right to carry.
“There’s not enough police in America to stop all of the threats,” said Chitwood.
Chitwood adds that in his experience licensed gun owners tend to be some of the most law-abiding citizens he encounters, and that just one citizen prepared for a bad situation could make all the difference.

A Celebration of the Heart of America:
As we watch SO MANY tear at the very fabric of our nation and our heritage it is so refreshing and heartwarming to see how this 11-year old young man showed his appreciation of the sacrifices of so many at the 70th Anniversary of D-Day in Normandy. It is wonderful to see that Patriotism is not dead!! Kudos to this young man’s parents for instilling in him the values that so many have made the ultimate sacrifice for. As a Veteran it made my eyes sweat!
One Forgotten American Hero Among Many
America doesn’t know his name. Let’s fix that. He is Officer Michael Louviere, of the Westwego Louisiana Police Dept. Michael was a 26 yr. old police officer and a US Marine who served in Afghanistan. He was husband to Ashley and the father of two small children.
No one deserves to be killed unjustly. No one. Michael was murdered in 2017, and his story didn’t get nationwide attention. The mainstream media didn’t think we all needed to remember Michael Louviere’s name.
Yes, you can find an article or two from CNN and Washington Post. One article does not a huge story make. Most of us had never heard his name. Well, not anymore. We are making sure everyone knows his name.
Officer Louviere was off duty and on his way home to see his family. He was in full uniform and stopped when he saw what he believed was a car accident. He was killed while trying to save the life of a stranger. Michael was selflessly helping another when he was murdered.
Officer Louviere spoke to a man in a U-Haul truck, then he attended to a pregnant woman who was bleeding on the ground from a gunshot wound. While leaning over to help the woman, Michael was shot in the back of the head by the man driving the U-Haul. Sylvester Holt, a career criminal, took Michael’s life. Later, Holt being the true coward that he was, committed suicide.
There was no televised funeral for him, no horse-drawn carriage.
No worldwide outrage over this senseless killing. No one painted a mural of Officer Louviere or burned buildings in protest.
Universities haven’t offered free tuition to his two children.
Most of us had never heard of him before.
His life mattered just as much. This man is a hero. Remember him. Share this story.
The Left’s Declaration of War: Whether we realize it or not, we're in a state of war. The war has not been declared by any of our geopolitical enemies; it has been declared by the radical Left. There is a deliberate attempt to overthrow our current form of government and introduce a socialist/Marxist government. You may not have been aware, but since you're aware now, you have a decision to make. Do you ignore it or join the fight?
Let me share some bullet points we ALL should understand. First, defending the freedom that once made America the envy of the world is a cause worth dying for. You only have to look back over our history to see how many American military personnel laid down their lives for our freedoms (over 1.4 million).
The media has become so corrupt and biased that you cannot believe them most of the time. They constantly pound the drum that this is a racist, evil, and corrupt nation as they destroy as many elements of our shared history as possible while the Left cheers them on and conservatives are too often silent.
This next election could very well bring about the destruction of all we hold dear if we refuse to fight. You may not like Trump or his tweets, but is that a good enough reason to vote for far-left policies, or worse, not vote at all, as millions of conservatives have done in the past two presidential elections? Doing nothing is no longer an option in our view!
