Court strikes down Texas voter ID law as discriminatory :: 07/22/2016

A federal appeals court has ruled that a Texas law requiring voters produce one of seven forms of acceptable identification in order to vote is discriminatory. The panel left the requirement to show ID in place, but ordered the state to accommodate those who cannot.

The U.S. 5th Circuit Court in New Orleans found Wednesday that the law violates provisions of the Voting Rights Act. It ordered a lower court to determine ways Texas can fix the law prior to the presidential election this fall.

The law has been challenged in court almost from the moment it was approved by the Republican-controlled Legislature in 2011 — and has now had a series of major rulings go against it…

During this year’s presidential election, voters will still be required to show picture identification to cast ballots. But Wednesday’s ruling means those who can’t must still be allowed to vote — and that a lower court will have to help Texas devise ways to accommodate them.

It’s not clear when those suggested fixes will be ready or how they will be implemented once they are.

A three-judge panel of the court had found last year that the law violated the Federal Voting Rights Act. The full appeals court then decided to hear the case and determined that Hispanics were twice as likely and blacks three times more likely than whites to lack an acceptable ID under the law.

Which begs the question; if requiring a photo ID to vote is discriminatory, how is it not equally discriminatory to require a photo ID to buy a gun? Does the Justice Department not want Hispanics and blacks to be able to defend themselves?
