Castle Doctrine: Man taken into custody after deadly shooting released with no charges-SC :: 11/20/2014

A man who was taken into custody after a deadly shooting in North Myrtle Beach Tuesday has been released from jail without being charged in connection with the case.

The man was taken into custody for questioning after a shooting at a mobile home park on Parkway Drive in the Waterway View Mobile Home Park Tuesday night.

The man was booked into J. Reuben Long Detention Center at 8:27 p.m. but released at 3:32 a.m. with no charges listed on the jail's website.

North Myrtle Beach Police Chief Phillip Webster said an argument led to the shooting.

Horry County Solicitor Jimmy Richardson said the Solicitor's office responded to the scene with police and advised North Myrtle Beach police not to charge the suspect because the incident could fall under the Protection of Persons and Property Act, or "Castle Doctrine."

Richardson said the Castle Doctrine covers a case of self-defense when someone is inside your home or any place you have a right to be.

Pat Dowling, spokesperson for North Myrtle Beach , said the Public Safety Department is still investigating the relationship between both men and the events that occurred that evening.

WPDE is no longer naming the man who was taken into custody since he has not been charged with any crime.
