California Self-Defense: Suspected burglar shot in Hollister home :: 05/10/2021
A Hollister woman woke up this morning to find a suspected burglar inside her walk-in closet and after giving him orders to leave and firing several warning shots she shot the man, hitting him in the leg.
“I'm dumbfounded over the whole thing,” said neighbor Richard Postigo.
The shooting happened around six Monday morning in a gated community known as Montebello estates on the 33-hundred block of Cienega road just outside Hollister.
The man shot is 18-year-old Ocean Burger. The shooter is the homeowner and mother of two young children; her husband says his wife went into mama bear mode when she decided to arm herself.
“That's what her mother and aunt were telling me that she was, protect my kids first,” said Postigo.
Investigators say Burger was armed with several knives and a machete when the mother confronted him inside her closet. They say Burger ignored orders to leave and when the homeowner fired several warning shots he allegedly advanced towards her, that's when the mother fired at the accused burglar hitting him in the leg. And California law may be on her side.
“There is a presumption that favors the homeowner they're presumed that the person is in imminent fear of either death or great bodily injury,” said Ellen Campos, assistant district attorney for San Benito county.
“You got somebody nuts in the head inside your house I don't know if he had a knife I thought I heard maybe he had a knife you just can't stand still and do nothing,” said Postigo.
Investigators say they will not recommend any charges be filed against her.
The quiet gated community with white picket fences, manicured lawns and million-dollar homes is the same neighborhood where a husband murdered his wife in 2017.
Sang Ji, 50, was convicted last year of bludgeoning to death his 48-year old wife Yoon “Clara” Ji and then dumping her body down a ravine on Salinas grade road near San Juan Bautista.
