California Self-Defense: Drunk Home Invader Winds Up With Extra Shots :: 03/14/2016
File this one under “what else was he supposed to do?” A homeowner in Santa Clarita fatally shot a man who allegedly tried to break into his apartment, authorities said.
The shooting was reported around 9:10 p.m. in the 26000 block of Isabella Parkway in the Canyon Country area, according to a news release from the Los Angeles County Sheriff’s Department.
When deputies arrived, they found a man in his 40s suffering from multiple gunshot wounds. The man was transported to a hospital where he was pronounced dead, according to the news release.
The homeowner and witnesses told deputies that the man was trying to enter the homeowner’s apartment after he was told several times to leave and did not comply, according to the news release.
The man then broke a window and began to climb inside the apartment when the homeowner shot him, according to the news release.
The homeowner told the drunk man to leave multiple times. The drunk responded by breaking a window and attempting to enter the residence. The homeowner clearly had the right and the obligation to defend himself and his daughter from this home invasion.
It is prudent to assume that someone breaking into your home has ill intent, especially when you’ve warned them to leave multiple times.
There is some speculation that the home invader was confused, and was attempting to enter what he thought was his own dwelling. The complex has different building numbers, but the same apartment numbers within the buildings.
That initial confusion allowed, I’d argue that when he went to an apartment 203, his key didn’t work, and the voice inside warning him to leave was in another language (the homeowner spoke English; the home invader only spoke Spanish), he should have clued in to the fact that he was in the wrong place.
The homeowner did what I think the vast majority of reasonable people would do, and fired shots to defend his family.
He did everything about as right as you can under the circumstances.
Unfortunately, the drunk home invader did everything wrong.
