House Floor Vote 'imminent' on HB 2011 - Preemption Law Improvements

PA law is violated every day by dozens, if not hundreds, of communities that enact or maintain laws that are NOT legal!  PA Pre-emption law, Title 18 - §6120, specifically prohibits 'local gun laws' and yet there is 'no' enforcement actions taken against these local communities.  These laws put each of us at risk of violating a patch work quilt of local laws and at the mercy of anti-gun local tyrants seeking to step on us to further their anti-gun philosophy.

Even former Philadelphia former District Attorney Lynne Abraham recognized that the local gun control package of legislation passed by Philadelphia City Council was 'unconstitutional' and stated she would not enforce them (4/15/2008).&nbs! p; This is D/A Abraham' direct quote, "I know that the ordinances are invalid and unenforceable according to the Supreme Court of Pennsylvania."  So where are citizens to turn if invalid acts can be allowed to stand?  HB 2011 is the answer to this question.

We NEED standing in the courts, and HB 2011 is a long overdue clarification of the 'standing' issue as well as provides the tools to citizens and grassroots organizations to stand up to these rampant violations of our state firearms pre-emption law (Title 18, §6120).  If a court of law finds that an ordinance has violated Pennsylvania Preemption law (Title 18, §6120), the local government shall pay the actual damages! and reasonable attorney fees and costs to the party who successfully challenges the regulation.

The recent court case in Erie (Dillon v. City of Erie) is but one of hundreds of incidents where gunowners took a stand with local communities who have illegal firearms ordinances.  This was 'very' expensive and the gun owners involved are still faced with paying off huge legal fees.

Unfortunately anti-gun groups (led by Cease Fire PA and Bloomberg's 'Mayors Against Illegal Guns) are ‘denying the rule of law’ and condoning the illegal local laws.  They must NOT be allowed to derail this legislation and hold the political process 'hostage' with anti-gun amendments (124 so far).
