1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, further providing for the offense of firearms not
4to be carried without a license.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 6106(a) of Title 18 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 6106. Firearms not to be carried without a license.

10(a) Offense defined.--

11(1) Except as provided in paragraph (2), any person who
12carries a firearm in any vehicle or any person who carries a
13firearm concealed on or about his person, except in his place
14of abode or fixed place of business, without a valid and
15lawfully issued license under this chapter commits a felony
16of the third degree[.] and shall, upon conviction, serve a 
17mandatory minimum one-year sentence.

18(2) A person who is otherwise eligible to possess a
19valid license under this chapter but carries a firearm in any

1vehicle or any person who carries a firearm concealed on or
2about his person, except in his place of abode or fixed place
3of business, without a valid and lawfully issued license and
4has not committed any other criminal violation commits a
5misdemeanor of the first degree[.] and shall, upon 
6conviction, serve a mandatory minimum one-year sentence.
